I-9 Compliance and Worksite Enforcement in 2018 

Session Description

From its initial days, the Trump administration has made worksite enforcement a political priority. Now, after tripling the number of Immigration & Customs Enforcement agents, along with promises to quintuple its worksite enforcement activities, the administration has reinforced the concept that employers must monitor and police their workforces. This session will address methods by which to establish effective compliance programs, options associated with cleaning up problematic Forms I-9, and recent audit and investigation activity by immigration authorities. Finally, this session will discuss developing areas in employment-based immigration enforcement and highlight steps employers should be taking to ensure they are prepared for a variety of government visitors.

Speakers

Samantha Lloyd

Samantha Lloyd is an Associate Attorney at Ogletree Deakins, who concentrates in complex corporate immigration matters for companies of all sizes, including H 1B, H-2B, L-1, O-1, and TN non-immigrant visas; PERM Labor Certifications and EB- 2/3 immigrant petitions; and EB-1 Extraordinary Ability/Multinational Manager immigrant petitions. Samantha also frequently participates in pro bono clinics. After undergrad, Samantha deferred law school for a year to teach English to high-school students in Spain. She is proficient in speaking and reading Spanish.

Chris Thomas

Chris Thomas is a Shareholder at Ogletree Deakins, who practices exclusively in the area of immigration law. He represents companies throughout the world in developing global mobility policies, securing necessary work visas and permanent resident cards for employees, advising on I-9 compliance issues, and representing companies in government audits and investigations. Mr. Thomas has extensive experience in employment-based immigration law and manages the Denver office’s immigration practice. He advises and represents companies in the preparation of employment-based nonimmigrant petitions (e.g., B, E, H, L, O, P, R, and TN petitions), labor certification (PERM) applications, immigrant petitions (all preference categories), and adjustment of status and consular processing applications.He represents companies undergoing immigration-related investigations, including I-9 audits, public access file reviews, SEVIS evaluations, onsite inspections, and a variety of other government probes. In addition, to prepare companies for the possibility of such government activity, he helps them in their efforts to establish successful compliance programs.He also represents companies in developing effective international mobility policies, helping them to secure appropriate work visas for outbound workers (e.g., transferring employees from a U.S. facility to work on a project in China, etc.) and assisting them in establishing compliance programs on a global basis.
