Session Description "Free speech" concerns have reached a fever pitch in light of the pandemic, protests, and polarized political climate. As a result, HR professionals are faced with never-before encountered questions about how to avoid workplace disputes, maintain respectful discourse, and all the while permit employees to voice diverging beliefs. With COVID-19 still raging, how can employers ensure all employees' safety while respecting complaints of employees and customers? In the wake of Black Lives Matter protests, how can you support Black History Month and diversity efforts while respecting the views of those who disagree? What should you do when an employee complains about a pride flag on an employee's desk? How can you navigate a heated political conversation after an extremely polarized election? This presentation will answer these questions, and many more, in discussing the competing aims and legal requirements facing HR professionals. Bios Steve Baumann is an associate at the Denver offices of Littler law firm. He partners with employers of all sizes, from small startups to Fortune 500 companies, to address and resolve employment and traditional labor issues throughout the employment life cycle, from hiring through performance management, investigations, and separation of employment. Among other things, Steve advises employers about the protection of trade secrets, enforcement of non-compete agreements, and other unfair competition. Steve also helps employers remain union-free and manage their union-represented workplaces.
